TerraCycle, a company selling vermicompost in recycled soda and milk containers, is being sued by Scotts Miracle-Gro for false advertising and trade dress infringement, Advertising Age reported. (Free registration required.)
TerraCycle has launched a Web site, SuedbyScotts.com, that gives side-by-side comparisons of the companies. The site also mentions 81 other garden products that use green and yellow packaging similar to Miracle-Gro’s.

I can't believe that Miracle Gro is soo scared by such a small company. They should be ashamed and instead of suing they should come out with great organic products (like TerraCycle) to compete. This is a cheap tactic by a large company. I'm worried that if they win we will be stuck with chemicals. What a sad world.

I believe this lawsuit is Scott's trying to protect its assumed growth in the organic fertilizer market which is growing rapidly especially in light of increased state & federal govt oversight of the conventional fertilizer market.
Its not a coincidence that Scotts has been trying to grow its Organic Choice® line for several years now. I've written extensively about it on my blog
